Terms of service.

Last updated October 17, 2026

These terms cover Swear By, referral software for home service businesses. Using Swear By means you agree to them and to our privacy policy.

For businesses

  • Your account. Keep your sign-ins to yourself. You're responsible for what your staff do in Swear By.
  • Your program. You set the offer, the rewards and the rules, and you make sure they're legal where you work. Our compliance tools are guardrails, not legal advice.
  • Your customers. Only give us customer information you have the right to share. It stays yours, and we use it to run your program.
  • Messages. Campaign emails carry your mailing address and an unsubscribe link. Texts go only to people who agreed to them.
  • Rewards. You fund rewards ahead of time in your reward wallet, and they pass through at cost, with no markup. They go out through our payout provider, after the holds and approvals you set.
  • Fees. One plan at $149 a month. There's no fee per referral and no share of your jobs. A custom plan for several locations is agreed in writing. Plan fees start after you go live.
  • Setup. Included. We set up your program with you before you go live.
  • Guarantee. If no referred customer books within 30 days of going live, we credit your second month's plan fee.
  • Late payments. If a payment fails, we let you know. After a grace period, campaign invites pause until it's paid.
  • Taxes. You pay the rewards, so you're the payer. Swear By collects W-9s and gives you a 1099 export. You file the forms.
  • Canceling. You can cancel any time.

For people who refer

  • Rewards come from the business. The business that invited you sets the rewards and decides who earns them. A reward can be held, reviewed or declined, for example for a self-referral, someone who was already a customer, or a referral outside the window.
  • Getting paid. Rewards are delivered through Tremendous. For cash rewards you pick how to take it, like Venmo, PayPal, bank transfer or a gift card. Tremendous's terms apply when you cash out.
  • Taxes. Rewards can be taxable income. The business may need your W-9 before it pays you.
  • Texts. Message frequency varies. Message and data rates may apply. Reply STOP to stop, HELP for help.

Fair use

Don't refer yourself, make up referrals, send spam, pretend to be someone else, or try to break, overload or copy Swear By. We may block referrals and accounts that do.

Our part

We work to keep Swear By running and your data safe, but we can't promise it's never down or free of errors. Swear By is provided as is. As far as the law allows, we aren't liable for indirect damages or lost profits, and our total liability is limited to the fees you paid us in the 12 months before the claim.
